This Marketing Privacy Policy ("Privacy Policy") explains our data practices in connection with the provision of our service, including https://www.talklifeworkplace.com/, and our marketing and feedback based activities. In this Privacy Policy, we describe the information we collect about you in connection with our activities. This policy details how TalkLife collects, uses and discloses information, and what choices you have with respect to the information.


When we refer to “TalkLife”, “we”, “our”, “us”, we mean TalkLife Limited of Runway East Building, 1 Victoria Street, Bristol, United Kingdom that acts as the controller or processor of your information, as explained in more detail in the “Our Legal Bases For Processing Information” below.

 

This Privacy Policy does not apply to use of the TalkLife Workplace product that we provide to our users (platform, app and related online services), which allows users to interact and share information online. Information We Collect And Receive

TalkLife must receive or collect some information to market, provide, improve, understand, customise and support TalkLife Workplace Services. The types of information we receive and collect depend on the services you require. We may collect and process the following data about you:

Your contact information. We collect your email address and basic information such as your name, job title, organisation name and phone number when you, for example, contact us or request information in connection with TalkLife Workplace (using a form on the website), sign-up for marketing materials, download resources or request a TalkLife Workplace demo. If you don’t provide us with this information, we may not be able to provide the requested service.

 

Payment & account details. We may collect information you provide to us including your chosen payment method(s) and subscription plan. We collect this information in a number of ways, including when you enter it on our website, interact with our customer service; information when you choose to provide preferences, account settings, or otherwise provide information to us through our service or elsewhere.

 

Customer support. You may provide us with information related to your use of our services or requesting further information regarding our services, and how we can contact you so that we can provide you with customer support. For example, you may send us an email with information relating to our app performance or other issues. If you contact us, we may keep a record of that correspondence.

 

Survey and feedback information. We may collect information from you if you optionally participate in one of our surveys. For example, we occasionally conduct feedback surveys to better understand our customers' marketing experience when purchasing TalkLife Workplace.

Service Partners We Use to Store & Process Your Data

 

Stripe. We use Stripe for payment, analytics, and other business services. Stripe collects and processes personal data, including identifying information about the devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us, including for fraud detection and prevention.

 

Please note that payment details including credit card numbers are supplied directly to Stripe. We do not receive or store financial details, other than the bare minimum needed to trace transactions for audit or error checking purposes . For anti-fraud reasons and to ensure your payments have not been misused, your personal data may be supplied by our payment partners to relevant third parties including credit reference and fraud prevention agencies, who may keep a record of that information.

Hubspot. HubSpot is an integrated software solution which we use to cover various aspects of our online marketing, including contact management (e.g. user segmentation and CRM), landing pages, email marketing and contact forms. Mailchimp. We utilise Mailchimp to send out newsletters and promotional material to our customers. We use the information we have (subject to choices you make) to operate, provide, improve, understand, customise, support and market our Services. Here’s how:

 

Our services. We use the information we have to offer, provide and operate our Services, including providing customer support, and improving, fixing and customising our services. It is in our interest to understand how people use our Services and analyse and use the information we have to evaluate and improve our Services, research, develop and test new services and features, and conduct troubleshooting activities. Assignment, Change Of Control, And Transfer

All of our rights and obligations under our Privacy Policy are freely assignable by us to any of our affiliates, in connection with a merger, acquisition, restructuring, or sale of assets, or by operation of law or otherwise, and we may transfer your information to any of our affiliates, successor entities, or new owner.

 

If TalkLife Ltd or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets; and If we are under a duty to disclose or share your personal data in order to comply with any legal obligation (including responding to requests from law enforcement authorities both inside and outside the EEA), or in order to enforce or apply our terms of use and other agreements; or to protect our rights, property, or safety, or that of our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction, and may require us to transfer your personal data outside of the EEA.

How the General Data Protection Regulation Applies To Our European Region Users

The General Data Protection Regulation (2016/679 EU) (EU GDPR) is the governing legislation for collecting and processing personal data in the EU. Following the end of the Brexit transition period on 31 December 2020, most of the EU GDPR was retained in UK law by the European Union  (Withdrawal) Act 2018. The retained GDPR is known as the "UK GDPR". The UK GDPR is supplemented by the Data Protection Act 2018. As a UK based company, all TalkLife activities therefore comply with UK GDPR and the Data Protection Act 2018.

 

Our Legal Bases For Processing Information

Under the UK GDPR or other applicable local laws, you have the right to access, rectify, port, erase your information and lodge a complaint with a supervisory authority, as well as the right to restrict and object to certain processing of your information. This includes the right to object to our processing of your information for direct marketing and the right to object to our processing of your information where we are performing a task in the public interest or pursuing our legitimate interests or those of a third party. If we process your information based on our legitimate interests or those of a third party, or in the public interest, you can object to this processing, and we will cease processing your information, unless the processing is based on compelling legitimate grounds or is needed for legal reasons. You can also object to our processing of your information. For marketing communications, we will always seek your opt in consent. Where we use your information for direct marketing for our own Services, you can always object and opt out of future marketing messages using the unsubscribe link in such communications, or by contacting DPO@talklife.com.

Managing And Deleting Your Information

We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. TalkLife will retain your information that we collect if you provide feedback for the duration of our service provision and for such time thereafter as required to conduct analyses or otherwise verify the feedback. TalkLife will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your personal information to comply with applicable law), to resolve disputes and to enforce our terms. Once these retention timelines have passed and we have no further specific reason to retain that personal information, the relevant personal information will be deleted.

Law And Protection

We collect, use, preserve, and share your information if we have a good-faith belief that it is reasonably necessary to: (a) respond pursuant to applicable law or regulations, to legal process, or to government requests; (b) enforce our terms and any other applicable terms and policies, including for investigations of potential violations; (c) detect, investigate, prevent, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of our users, TalkLife Limited, or others, including to prevent death or imminent bodily harm.

Our Global Operations

TalkLife shares information globally, both internally, and externally with our partners in accordance with this Privacy Policy. Information controlled by TalkLife Limited will be transferred or transmitted to, or stored and processed, in the United Kingdom or other countries outside of where you live for the purposes as described in this Privacy Policy. We utilise standard contract clauses approved by the European Commission, and may rely on adequacy regulations (the UK equivalent to the European Commission’s adequacy decisions) about certain countries, as applicable, for data transfers from the United Kingdom to the European Economic Area and other countries.

Changes to our privacy policy

This privacy policy is reviewed annually. We will also occasionally update this Privacy Policy to reflect changes in our practices and services. When we post changes to this Privacy Policy, we will revise the "Last Updated" date at the top of this Privacy Policy and the revised Privacy Policy will come into effect on the date it was posted to our site or our app or as otherwise notified by us. If we make any material changes in the way we collect, use, and/or share your personal information, we will notify you by email.
